1. ACTIVITIES
Montania Adventures
THE GUIDES
Our guides hold qualifications as sports technicians issued by the Ministry of Education and Science, with expertise in conducting activities in High or Medium Mountain, Canyoning, or Climbing.
CANCELLATION OR MODIFICATION
Montania Adventures reserves the right to cancel or modify activities due to weather conditions or any circumstances that could affect the safety of the group. We also reserve the right to exclude any participant if their behavior endangers their own safety, the safety of the group, or shows disrespect to the environment or fellow participants. This will not entitle the participant to a refund. The company provides complaint forms upon request.
The client
REQUIRED LEVEL
If a client does not meet the required or agreed-upon level, either technical or physical, the guide may, if possible, alter the itinerary or program to adapt to the participant’s level. Additionally, the guide may adjust the program depending on weather conditions or the state of the mountain to ensure safety. The Guide/Client ratio will be maintained, prioritizing safety and respecting the minimum number of participants agreed upon for each course or activity.
HEALTH CONDITIONS AND USE OF SUBSTANCES
The client is obliged to inform the guide of any health problems, allergies, or cardiovascular conditions before booking any activity. The client agrees to follow all instructions from the guide during the activity and not to be under the influence of alcohol, drugs, or any other substances that may impair their ability to react.
TRANSPORTATION
Transportation to the activity location agreed upon with Montania Adventures is the responsibility of the client. The contract and the guide’s responsibility only apply to the direct work and organization of the activities.
EQUIPMENT
Loss, negligence, or misuse of equipment provided by the guide (beyond normal wear and tear or force majeure) will be the client’s responsibility and must be paid for directly to the guide, regardless of the activity price.
WATER ACTIVITES
It is mandatory to know how to swim. The technical sheet for each activity will specify the conditions, necessary equipment the client should provide, and the minimum age required to participate. Minors must be accompanied by their legal guardian or a responsible adult. If not, they must have written authorization signed by their legal guardian.
2. INSURANCE
According to Decree 56/2003, Montania Adventures includes accident insurance and liability coverage in the price of all activities (unless expressly stated otherwise). It is recommended that clients have a valid federation card (Fedme).
3. RESERVATIONS AND PAYMENTS.
RESERVATION PROCESS
On our website, we offer various reservation processes and cancellation policies. Typically, two payments are required:
- Reservation deposit.
- Remaining balance.
ONE-DAY ACTIVITIES
The reservation deposit represents 50% of the total price of the activty and must be paid to complete the reservation and secure the date for your ativity. Without the deposit, the reservation will not be confirmed.
- The remaining balance must be paid at least 7 days prior to the scheduled start date of the activity. Failure to complete the payment in time will result in the automatic cancellation of the activity without a refund of the reservation deposit.
- If the reservation is made at the last minute (less than 7 days before the scheduled start date), full payment for the activity will be required.
TRIPS, ADVENTURE PACKS AND COURSES
- The remaining balance must be paid in full no later than 20 days before the trip start date. Failure to pay the outstanding balance within this period will result in automatic cancellation of the booking, with no right to a refund of the deposit, in accordance with the applicable cancellation conditions.
- For bookings made within 20 days of the trip start date, full payment must be made at the time of booking.
WHERE TO MAKE THE PAYMENT
Payments can be made via bank transfer to the BBVA account number ES02 0182 5319 7302 0243 2102. Please include your full name and the name of the activity as the reference, and send us the receipt once the transfer is completed.
4.CANCELLATIONS

FORCE MAJEURE
We regret that we cannot accept responsibility or provide compensation in case the activity is cancelled due to force majeure events such as war, civil unrest, terrorism, natural disasters, adverse weather conditions, fire, and similar events beyond our control. If an activity is cancelled due to force majeure, it may be rescheduled to another agreed-upon date at no additional cost.
GUIDE ILLNES
Montania Adventures reserves the right to cancel any activity prior to its commencement due to force majeure, such as guide illness. In this case, a full and immediate refund of the entire payment will be provided.
The client
CANCELLATION NOTIFICATION
Cancellations must always be notified by phone (+34 681 676 777), via WhatsApp, or by email (hola@montaniaadventures.com).
ONE-DAY ACTIVITIES
- If a participant cancels for reasons outside of Montania Adventures and notifies us 7 or more days before the activity, 80% of the registration fee will be refunded.
- If the cancellation occurs between 6 and 3 days before the activity, 20% of the total fee will be refunded.
- If a participant cancels within 72 hours of the activity, does not show up, or leaves the activity once it has started, no refund will be issued.
TRIPS, ADVENTURE PACKS AND COURSES
- Cancellations must be notified at least 20 days in advance in order to be eligible for a refund of the booking deposit. In this case, the amount paid will be refunded minus €80 in administration fees.
- Cancellations made within 20 days prior to the activity start date will not be eligible for any refund, and the full amount paid will be forfeited. However, the participant may transfer their place to another person, provided that the replacement meets the activity requirements and prior notice is given to the organization.
5. EQUIPMENT RENTAL
Montania Adventures
TERMS AND CONDITIONS
Montania Adventures, hereinafter referred to as “Montania,” offers clients the opportunity to rent various types of mountain equipment for a specified price and duration. The use of equipment rented from Montania is restricted to the territorial area of Valencia, Castellón, and Alicante. If the CLIENT intends to use it outside this area, they must expressly notify Montania. Montania will not be held responsible for any incidents occurring outside the aforementioned territorial area of the Valencian Community, except for the case contemplated in Clause Five of these general conditions.
RENTED EQUIPMENT AND DURATION
The rental price depends on the selected equipment and the duration requested by the client. Payment must always be made in advance at the time of booking.
MONTANIA’S OBLIGATIONS
- Provide the client with equipment in proper working and usable condition.
- Inspect and check each returned item, charging the client for any damages that may have occurred during the rental period.
TERMINATION OF THE CONTRACT
Montania may terminate this contract by written notice if any of the following circumstances occur:
- A serious breach of the contract, in which case the lessee will not have any right to claims or compensation.
- An inability to continue providing the service.
- Unavailability of stock.
APPLICABLE LAW AND JURISDICTION
The relationship between Montania and the user shall be governed by the current Spanish legislation, and any disputes shall be submitted to the courts and tribunals of the city of VALENCIA.
THE CLIENT
CLIENT OBLIGATIONS
- The rental contract holder must be over 18 years old and is responsible for the rented equipment. They must also possess a National Identity Document (DNI) or Passport.
- Collect and return the rented equipment supplied by Montania at the agreed location and dates at the beginning and end of the rental period.
- Return the rented equipment to Montania in good condition.
- Use the rented equipment responsibly and appropriately, ensuring its integrity, proper functioning, and avoiding situations where it could be damaged.
- Pay the full cost of repairs for any damage caused due to negligent or careless use during the rental period. The amount will be specified in a repair estimate sent by Montania to the CLIENT at the address provided in these General Terms and Conditions. A payment order will be generated on the bank card, PayPal, or other authorized platforms, which must be settled within 48 hours.
- Pay the full replacement cost of the equipment and its accessories in case of theft, loss, irreparable damage, or misplacement of accessories rented from Montania. The replacement cost will be based on the rates listed in the ANNEX of these General Terms and Conditions. A payment order will be generated on the bank card, which must be settled within 72 hours. A charge for the replacement amount will be made through the payment terminal of Cuestarriba Guías de Pirineos S.C., located at Calle O’Cuatron No. 3, 22370 Broto (HUESCA), which will be provided with the necessary data to process the payment.
- The CLIENT may not rent, mortgage, pledge, sell, lend, or otherwise use the rented equipment as collateral.
- The CLIENT declares that they are in suitable physical and psychological condition to engage in activities using the rented equipment and that they are not under the influence of relaxing, stimulating, or hallucinogenic substances at the time of rental.
DELIVERY DATES AND DEADLINES
If the rented equipment is not returned on the agreed date, the CLIENT will be charged a penalty fee of 50% per day of delay based on the total order amount. A payment order for this amount will be generated on the bank card, PayPal, or other authorized platforms, and the CLIENT must settle it within 48 hours. If the equipment is not returned within 4 calendar days from the agreed return date, the CLIENT agrees to pay the replacement cost according to the rates listed in the ANNEX of these General Terms and Conditions. The rental period will be counted from the last day of the agreed rental period until the day the equipment is returned to Montania.
LIMITATION OF LIABILITY
The client acknowledges and agrees that Montania shall not be held responsible for:
- Equipment returned by a third party that is damaged or defective to the extent that it cannot be rented to another client.
- Claims for accidents, injuries, impacts, or damages caused to themselves or third parties (persons or property) during the rental period.
- Events caused by force majeure.
